Washcaro Terms & Conditions
By accessing or using the WashCaro website, app, services, or by entering into any franchise/partner arrangement with us, you agree to be bound by these Terms & Conditions ("Terms") and the Privacy Policy. If you are a franchisee/partner, these Terms also include supplemental partner guidelines, performance rules, and quality standards. These Terms govern all users: customers, franchisees/partners, and service providers.
A. INTRODUCTION & SCOPE
1. Who we are: WashCaro (Manvis Connects OPC Pvt Ltd) offers car & bike wash, detailing, interior/exterior cleaning, coating, mobile/doorstep wash, and franchises/partnerships.
2. What these Terms cover: Use of the platform (website/app), booking & delivery of services, franchise/partnership rules, privacy/data protection.
3. Supplemental Terms: Along with these Terms, there may be additional guidelines, SOPs, partner agreements, operating rules, or performance benchmarks specific to your city or service type. These Supplemental Terms are integral; in case of conflict, supplemental or more specific rules prevail.
B. ELIGIBILITY & ACCOUNT REGISTRATION
1. Eligibility: You must be at least 18 years of age, have valid government ID (Aadhaar / PAN etc.), meet local licensing and regulatory requirements in Telangana.
2. Account Creation: Provide accurate, complete, up-to-date information. If you become a partner/franchisee, you may also need business registration, GST registration, trade licenses, relevant clearances.
3. Verification: We may do background checks, identity verification, criminal record check, etc. Access to leads or being accepted as partner/franchisee is subject to successful verification.
4. One Account: Unless explicitly allowed, no multiple accounts per person / entity. Sharing login credentials or allowing unauthorized access is prohibited.
C. SERVICES / OPERATIONS / FRANCHISEES & PARTNERS
1. Service Execution Responsibility: Franchisees / Service Providers are solely responsible for executing the service (quality, safety, timing). WashCaro is the facilitator / platform operator.
2. Standard Operating Procedures (SOPs): All partners must strictly follow WashCaro’s SOPs for cleaning, equipment use, safety, uniforms, professionalism, customer interaction. Deviation is a breach and can cause suspension or termination.
3. Audits & Inspections: WashCaro may conduct announced or unannounced audits at any time. If a franchisee or partner fails to meet quality, safety, hygiene, compliance or performance benchmarks in audit, corrective action will be taken, up to termination.
4. Equipment & Consumables: Obligatory use of approved detergents, cleaning materials, kits. Use of unverified or non-compliant products is prohibited and may lead to account deactivation or penalties.
5. Performance Benchmarks / Minimum Standards: Partners must meet certain benchmarks: customer ratings, response time, lead acceptance, service completion, hygiene. Failure to meet minimum standards for a specified time may trigger retraining, warning, suspension, or deboarding (removal from the platform).
6. Franchisee / Partner Withdrawal / Termination for Non-Compliance: We may terminate the partnership/franchise or deboard a partner immediately if there is fraud, misuse of brand, repeated failure to meet audits or performance standards, violation of laws/regulations, or damage to brand reputation.
D. PAYMENT, FEES, TAXES
1. Fees / Royalty / Platform Charges: Specified in your franchise / partner agreement. Payments to WashCaro (franchise fees, royalty, platform fees) must be made on time; late payments may attract interest or penalties.
2. Collection & Disbursement: WashCaro may collect payments from customers and remit partner’s / franchisee’s share after deducting fees, charges, commissions, or any penalties due.
3. Taxes & Legal Compliance: All earnings, fees etc. are subject to GST, TDS, and other taxes under Indian law. Franchisees/partners are responsible for their tax filings, registrations, and compliance.
4. Refunds / Cancellations by Users: As per WashCaro policy; service fees may be non-refundable if cancellation is late/after service started.
E. NO GUARANTEE / DISCLAIMER OF SALES & PROFITS
1. WashCaro does not guarantee any minimum number of orders, revenue, profit, or business success. Market demand, location, competition, franchisee performance, etc., affect outcomes.
2. Any projections, forecasts, promotional claims are illustrative only and not binding.
3. Franchisees / partners bear full risk of business losses, costs, overhead, investments.
F. DATA PRIVACY & SECURITY
1. Data Collection: We collect personal data (name, contact, address, vehicle details, payment info, usage data etc.) to provide services, manage bookings, improve platform, marketing (with consent).
2. Use & Sharing: Data may be shared with affiliates, third-party service providers (payment gateways, logistics), or legal authorities if required under law.
3. Protection: Data will be stored securely. We use reasonable security measures; you agree not to try to undermine platform security.
4. Rights: You have rights to access, correct, or request deletion of your data per Indian IT Act / Data Protection Rules.
G. CUSTOMER / USER RESPONSIBILITIES
1. Provide correct & complete vehicle details, safe access, remove valuables before service.
2. Report defects, damage or dissatisfaction within 24 hours so issue resolution can be triggered.
3. Cooperate with service provider’s safety and hygiene protocols.
H. INTELLECTUAL PROPERTY, BRAND & CONTENT USE
1. WashCaro’s trademarks, logos, content, web/app code, SOPs, branding materials are our property. Use only as per guidelines.
2. Feedback, reviews you submit may be used in marketing or publications; you grant WashCaro license to use them.
3. Prohibited: copying, sharing, using platform materials or brand assets outside granted permission; making false or misleading public claims or representations about WashCaro.
I. LIABILITY LIMITATIONS & INDEMNITY
1. WashCaro is not liable for service provider / franchisee negligence, damage to customer property, loss, delays caused by circumstances beyond control, or results you do not like.
2. Franchisees/partners must indemnify WashCaro for any claims, losses, damages arising from their service, legal non-compliance, customer complaints, or misconduct.
3. Our maximum liability in any single transaction is limited to the amount paid for that service.
J. TERMINATION & ACCOUNT DEACTIVATION
1. Termination by WashCaro: Immediate termination for breach (fraud, safety violation, misusing brand, non-compliance with audits/procedures, off-platform delivery, etc.).
2. Notice & Cure Period: In some cases, we may provide a notice to remedy breach within a specified time (e.g. 30 days), unless breach is severe (fraud, reputation risk).
3. Effects of Termination: Loss of access to platform, removal from directory, return/destroy branded materials or equipment, settlement of due payments after deductions, revocation of licences/rights.
K. AMENDMENTS, CHANGES & UPDATES
WashCaro may amend or update these Terms, pricing, SOPs, partner guidelines, or policies to reflect: changing regulations, operational improvements, business model shifts. Substantial changes will be notified via website/app/email. Continued use or operation implies acceptance.
L. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of India and the State of Telangana. Disputes shall be resolved by negotiation first, then if needed by mediation/arbitration in Hyderabad or in Telangana courts. Users/franchisees retain rights under the applicable consumer protection laws.
